The Leahy-Smith America Invents Act ("AIA") has been viewed as a blessing or a curse since its implementation. Its intention to invalidate bad patents and encourage innovation for the benefit of the general public has solved some problems its predecessor has left in its wake. However, the AIA is not without its own problems. This project aims to present recommendations to close the gap in pursuing a fairer and expedited patent review system.

This Symposium brings together industry experts to discuss the current climate of the patent industry. Along with the group’s data research collected through a survey circulated to hundreds of practitioners, judges, patent owners, litigators, and scholars of intellectual property law, this Symposium aims to present recommendations to move forward in patent reform.

Thomas Jefferson School of Law's intellectual property program is the highest in the country offering a concentration, a certificate through CLIP (Center for Law and Intellectual Property), clinics in both patent law and trademarks, and externships with premier intellectual property firms. Named as one of the top schools for intellectual property law and technology law by PreLaw magazine's Winter 2016 edition, the IP program directed by Professor Julie Cromer-Young offers premier IP courses taught by top professors in the industry, and is one of only seventeen schools approved by the USPTO (United States Patent and Trademark Office) to offer both patent and trademark law clinics.

The Continuing Bar Candidate (CBC) program offered by Thomas Jefferson School of Law demonstrates the school’s commitment to its graduates and their dreams of becoming licensed attorneys. The program is aimed at students who were unsuccessful at their first attempt at the California Bar Exam. The program comes at no cost to our graduates.

The CBC program has four components and the program is free to our alumni:

  1. Review of candidate Bar letters and Bar graded materials;
  2. Substantive and skill-based lectures and workshops;
  3. The opportunity to submit essays and performance tests for personalized and graded feedback; and
  4. Mock bar exams to test the readiness of candidates as they march towards the testing date.

For students located outside of the San Diego County locale, the program offers distance-learning support through telephone and email consultations. Workshops and lectures are recorded and posted on the TWEN page for off-site access.

Any alumni of the program is welcome to participate in the CBC. An orientation session starts the program, and most of the meetings occur in the evenings, once a week.

The Small Claims Self-Help Workshop provides free limited legal assistance for low to moderate income individuals and businesses with small claim issues. Thomas Jefferson alumni attorneys and law students provide half-hour consultations to litigants who need assistance when being sued, suing another party, or help recovering money for a small claims judgment. The small claims issues must involve monetary claims for $10,000 or less. The type of claims the Small Claims Self-Help Workshop provides assistance with includes, but is not limited to, landlord tenant, consumer, personal injury, and breach of contract claims. The workshop does not provide assistance for non-claims issues, including evictions, restraining orders, divorce, child support, injunctions, and traffic tickets.

The Thomas Jefferson School of Law provides a Mediation Program in coordination with the Probate Court of San Diego. Thomas Jefferson's Probate Court Mediation Program was established in order to provide mediation services to individuals who are experiencing conflict as a result of the needs of vulnerable family members, either the elderly or minors, usually in connection with a Conservatorship or Guardianship before the Court.

Cases are referred by the judges of the Probate Court. In addition, the Program is available for service referrals from San Diego Volunteer Lawyers Program, Office of the Family Law Facilitator and The Legal Aid Society of San Diego. These nonprofit programs provide legal services to indigent San Diego residents and hold free legal conservatorship and guardianships clinics affiliated with the San Diego Probate Court.

Information for our Clients

Mediation services are provided at no cost to referred clients. Mediation sessions are held at the Thomas Jefferson School of Law, located at 701 B Street in downtown San Diego. In general, due to the complex nature of these cases, participants should expect to spend three hours per mediation session. Clients will be given an appointment for Tuesday or Thursday evenings or Saturday mornings.

During the session, participants will have an uninterrupted opportunity to summarize the factual underpinning of their dispute, their concerns and feelings, and their hopes for the future. The parties also will have the opportunity to speak with each other in order to gain a better understanding of the other party’s perspective. Once the issues are understood, the mediators will assist the parties in building an agreement based on the common ground which has been identified.

Mediation provides a respectful and courteous process for thoughtful discussion of the issues in contention. Participants are expected to follow certain basic guidelines including: treating others with respect, not interrupting, taking responsibility for the outcome of the session and following the applicable California statutes regarding confidentiality of the mediation.

About Our Mediators

A dozen mediators currently take part in our Probate Court Mediation Program. The majority of the mediators are graduates of Thomas Jefferson School of Law and members of the California Bar. As students, the mediators participated in the Thomas Jefferson Mediation Program directed by Professor Ellen Waldman, in both classroom and courtroom settings, attending both class seminars and presiding over small claims mediations. Students who have completed both Introduction to Mediation and Advanced Mediation may apply to be observers for the Probate Court Mediation Program.

Our curriculum is one of the many reasons Thomas Jefferson School of Law is a great fit for current and former military, reservists and spouses. The rolling application schedule is perfectly suited for applicants who might arrive in San Diego on short notice and those whose career and life demands require the ability to switch between part-time and full-time, or daytime and evening enrollment. Our flexible curriculum options also allow students to pursue directed study and distance education courses that help meet the demands of active duty service and military transfers.

The academic rigors of law school can be exciting and quite challenging at the same time especially for those who might be entering law school after many years away from college. To help you perform to the best of your ability, TJSL provides students with comprehensive guidance and support through the Academic Success Program. Our dedicated and experienced ASP faculty and staff will help you develop the study, research, writing and other skills needed for success in law school and in your professional career.

Our curriculum is taught by experienced practitioners, many of whom are considered experts in their respective fields and some of whom, like professors William Slomanson and K.J. Greene, also served in the military. Our world-class, full-time faculty are also highly productive scholars, having authored hundreds of articles, collectively, in well-respected law journals, as well as widely-used casebooks.

In addition to our four Centers of Academic Excellence, the law school offers several academic areas in which it has significant strength, based on the exceptional credentials of the faculty and the valuable expertise they bring to the classroom. These academic specialties include:  

Thomas Jefferson School of Law offers a select group of our incoming students the opportunity to take part in one of three academic Fellowship Programs: criminal law, intellectual property law, and sports law and policy.

Students may earn academic credit and valuable professional experience through the Thomas Jefferson School of Law Veterans Legal Assistance Clinic (VLAC), which provides limited legal assistance and full-service legal representation to formerly homeless veterans affiliated with the Veterans Village of San Diego. The VLAC is one of several live-client legal clinics operated by the law school, including the new Veterans Self-Help Legal Clinic.

If your interest is your own law practice, Thomas Jefferson houses the innovative Center for Solo Practitioners, a 12-to-18-month program that supports recent graduates in establishing practices. To qualify, students must take courses in the Solo Practice Concentration.

At Thomas Jefferson School of Law, we believe strongly in providing our students with ample opportunities to develop and hone their lawyering skills in "real world" scenarios where they serve real clients and/or real employers. Students who take advantage of our Clinical Programs don't have to wait until after graduating and taking the bar to experience real lawyering. Students who participate in these opportunities benefit in numerous ways, including building their resumes and getting a taste of different areas of practice.

For instance, you can earn academic credit serving as an extern at law firms, government agencies, corporations and public interest organizations. You also can discover first-hand what it is like to be a lawyer by working in one of our several "live-client" clinics, serving small businesses and entrepreneurs, artists and inventors, or struggling veterans.

We are proud of the work our students perform through these clinics. Thomas Jefferson School of Law is one of only 11 law schools in the nation and the only law school in California to have both a USPTO certified Patent Clinic and Trademark Clinic, allowing students to help creative clients protect their works. The students working in our Veterans Legal Assistance Clinic have helped more than 500 formerly homeless veterans with their legal needs. We also offer a Veterans Self-Help Legal Workshop where our students work with licensed attorneys to provide assistance to veterans who are representing themselves in legal matters.

Through our highly successful Mediation Program, students resolve real disputes for real clients in Small Claims Court. We also have a Small Claims Workshop where students help individuals learn how to represent themselves in Small Claims Court.

Why should Thomas Jefferson School of Law be the school of choice for active duty service members, veterans and military spouses? We are dedicated to supporting those who serve or have served in numerous ways, including:

  1. Our academic policies meet the needs of active duty service members and those transitioning out of military service.  We offer both full-time and part-time enrollment (as well as the opportunity to switch between the two) and welcome entering classes in both the spring and the fall semesters.
  2. We have a large and vibrant community of military spouses, active duty service members and veteran students and alums.  Our culture reflects an understanding of the unique experiences and career goals of students with a military connection, and we have an on-campus chapter of Student Veterans of America.
  3. We offer generous merit scholarships for military spouses and current active duty service members.  
  4. We offer a Veterans Legal Assistance Clinic that partners with Veterans Village of San Diego, a residential rehabilitation program that helps homeless veterans get back on their feet. We also offer a Veterans Self-Help Clinic that provides legal assistance and guidance to veterans who are representing themselves in legal matters.
